Rep. Valerie Gaydos of Allegheny has called for the resignation of Magisterial District Judge Xander Orenstein following a controversial decision that led to tragic consequences. The judge had released Anthony Quesen on no-cash bail, who is now accused of killing Liquor Control Enforcement Officer Benjamin Brallier. Officer Brallier was part of the Pennsylvania State Police and resided in the 44th Legislative District.
In her statement, Gaydos expressed sympathy for those affected by Officer Brallier's death: “My heart goes out to Benjamin's family, friends and colleagues. We must unite to advocate for justice and reinforce our commitment to keeping our communities safe from violence and crime."
Gaydos criticized Judge Orenstein's decision, stating: “It’s unacceptable Anthony Quesen, the suspect in this tragic case, was released without bail by Judge Orenstein after he was charged with the criminal assault and robbery of a man in Pittsburgh’s Point State Park in June 2023." She emphasized the need for prioritizing public safety over judicial leniency.
The representative highlighted previous concerns regarding Judge Orenstein's decisions: “This isn’t the first time Orenstein’s decisions have come under scrutiny by public officials." She called for an investigation into his actions by relevant authorities, including the Pennsylvania Judicial Conduct Board.
Gaydos concluded with a call to action: “We owe it to Officer Brallier and to all citizens of Pennsylvania to ensure our courts protect public safety.” Her stance reflects a broader demand within the House for accountability concerning judicial practices perceived as endangering lives across Pennsylvania.
